GENERAL CONDITIONS OF SALE OF TSE TOURISME & TRANSPORT (CGV)

Article 1 – Service

The service provided by the COMPANY TSE TOURISME & TRANSPORT, consists of the provision of a Passenger Vehicle with Driver. The rates include the vehicle defined when ordering, a driver, fuel, kilometers and time determined when booking or when concluding the contract, transport of the customer’s luggage, toll costs, parking costs and occupants’ liability insurance. The service includes a wait of 15 minutes and 60 minutes for airports, beyond the allotted time the SOCIÉTÉ TSE TOURISME & TRANSPORT may incur costs for the provision of the vehicle with driver at the current rate (price of €30.00 per 15-minute period expected per vehicle beyond the scheduled time).

The costs of parking or entry to any place chosen by the customer or imposed during the service (parking, stations, airports, etc.) are not included in the service. Unless otherwise agreed by the parties beforehand, the service begins and ends at the place where the vehicle is parked, ie at the headquarters of the COMPANY TSE TOURISME & TRANSPORT; 26 rue Paul Beltçaguy, 13100 AIX EN PROVENCE, France, on the day and time fixed in the contract and ends on the day and time of return.

Article 2 – Price and Terms of Payment

The prices indicated in our tariffs include VAT at the rate set by the regulations in force for transport services. Night, weekend and holiday rates are increased by +20%. They get along from 8:00 p.m. to 7:00 a.m. for the night, from Saturday 8:00 p.m. to Monday 7:00 a.m. for the weekend and from the day before 8:00 p.m. to 7:00 a.m. the next day for public holidays. Any service must be the subject of a written reservation accompanied by the payment of a deposit equal to 50% of the agreed quote price in order to guarantee the reservation(s). The balance is payable the day before the day of performance of the service (cash, bank transfer, credit card). Any additional service and/or overrun will be invoiced on the basis of the rates in force on the date of performance of the service.

Article 3 – Reservation

All services must be subject to a written reservation. It mentions the place and date of performance of the service, the names and number of passengers as well as the name and contact details of the beneficiary of the service, even if the latter is one of the passengers. Any reservation cancellation must be notified 48 hours before the start of the service. In case of cancellation, 25% of the service will be due if it takes place between 48 and 24 hours, 50% if cancellation between 24 and 12 hours,

100% if cancellation 12 hours before the performance of the service. In all cases, the absence of the customer during the agreed date and time of the appointment, results in the total invoicing of the amount of the order.

Article 4 – Terms of Use

Under no circumstances may the customer ask the driver not to respect the highway code in the context of the performance of the service. The number of passengers authorized is that appearing in the technical characteristics of the vehicle. It can never be exceeded and must take into account the driver as a passenger. Damage of any kind caused to the vehicles of the TSE TOURISME & TRANSPORT COMPANY and/or others will be borne by the Customer unless it is demonstrated that they are caused by a third party. The occupants of the vehicle, employees, service providers and guests of the customer cannot be considered as third parties. The transport of animals is prohibited, except prior authorization duly mentioned on the contract. It is strictly forbidden to eat, drink and/or smoke inside the vehicle. The driver may, without him or the COMPANY TSE TOURISME & TRANSPORT being concerned, cease the performance of the service in the event of hurtful or insulting behavior towards him, in the event that a passenger is in a proven state of drunkenness. , in the event of the consumption of narcotics, if a passenger exposes himself outside the vehicle through one of its openings during the performance of the service (while moving and/or stationary).

Article 5 – Case of Force Majeure

In the event that TSE TOURISME & TRANSPORT is unable to provide the vehicle provided for in the contract, the deposit will be refunded, unless the two parties agree on the provision of another vehicle. TSE TOURISME & TRANSPORT reserves the right not to perform the service in the event of the occurrence of a case of force majeure, a fortuitous event, due to a third party or any event that may present a risk for anyone or for the vehicle. This non-execution of the service cannot give rise to any compensation for the customer. TSE TOURISME & TRANSPORT cannot be held liable for the damage caused in the event of delay of the vehicle due in particular to road traffic, traffic accidents or any other situation. We keep the right to change vehicles when the service is respected.

Article 6 – Applicable Law

These General Conditions are governed by French law. The Parties elect domicile at their respective headquarters and residences. All disputes relating to the interpretation and/or execution of the present will be the responsibility of the commercial court of AIX EN PROVENCE or if the customer is a non-professional natural person, the responsibility of the defendant’s headquarters.

Article 7 – Data Protection Act
